Malta
is a civil law jurisdiction. The trust institution was included in
our Statute Book when legislation was enacted setting the legal framework
for the development of our island as an international financial centre.
It was felt that the use of Malta as a financial centre by persons resident
in common law countries would be enhanced if provision were made for the
creation of trusts by these persons. Our Trusts Act, which is largely
based on the jersey law on trusts, came into force on the 30th June 1989.
It was subsequently amended in September 1994 with a view to updating it
in order to meet the ever-changing needs in the world of international
investment and finance, thereby making Malta a more attractive centre wherein
prospective foreign persons would settle their property. |
